Lucky Seven PERKS! Program

Welcome to the Lucky Seven PERKS! award program (the “Program”), owned and operated by Edwards Oil, Inc. d/b/a Lucky Seven General Stores. These Program terms and conditions form an agreement (the “Agreement”) between you (“You”) and Edwards Oil, Inc. and its affiliates and subsidiaries (“Company,” “we” or “us”).

YOU AGREE TO READ THESE TERMS AND CONDITIONS CAREFULLY BEFORE USING THE PROGRAM.  Please read this Agreement carefully.  If you do not agree to these terms and conditions, you may not participate in the Program.  Use of the Program signifies your agreement to the terms and conditions of use set forth below.

The Program is available for customers of Lucky Seven General Store, Lucky Seven Sporting Goods, and Little Brown Jug Stores. These Program rules are subject to change at the sole discretion of the Company without further notice to you.

  1. General Terms.

This Agreement is a legally binding agreement between you and the Company.  By using or participating in the Program, you agree to be legally bound by all of the terms and conditions of this Agreement.  This Agreement sets forth your rights and obligations with respect to your use of and participation in the Program.  If you have questions about this Agreement, please contact us. 

  1. Acceptance of Terms.

As stated previously, by using or participating in the Program you are expressly acknowledging and agreement that you are at least 16 years of age, that if you are ages 16-17 that you have express permission of your parent or legal guardian to participate, that you have read and understand the terms of this Agreement, that you understand that you are bound by the terms of this Agreement, and that you will comply with the terms and conditions of this Agreement and all applicable laws, rules, and regulations.

  1. Enrollment and Account Set Up.

To join the Program, you must meet the terms for participation established by the Company and obtain a Lucky Seven PERKS! card at a Company location.  Once you acquire a PERKS! card from a store attendant, that attendant will activate the card at the register and provide an opportunity for you to immediately register and set up the account from an in-store kiosk.  You will begin earning rewards once a card is activated and presented to the store attendant before paying for each transaction.  All PERKS! Cards can be registered at our in-store kiosk or online at www.luckysevengeneralstores.com/perks.  You will be required to supply a valid email address along with other required information.  You will also be required to establish an alternative identification ID number for your account – this can be a phone number or something similar.

You may only have one account linked to your name/business.   Attempting to establish more than one account for you or your business will result in points being forfeited and/or your account being deactivated.   Your membership in the Program will be renewed automatically each year on January 1st of each subsequent year as long as your account is open and active, or, at our sole discretion, until we give notice of the Program’s cancellation, or your account is otherwise deactivated.  The Program is not subject to an annual program fee.

Once your Lucky Seven PERKS! card is activated by the store attended and registered by you at www.luckysevengeneralstores.com/perks with a valid e-mail address, your account will be established. 

You may not use a username (or e-mail address) that is already being used by someone else, that may be construed as impersonating another person, that belongs to another person, that we determine may violate the intellectual property or other rights of any person, that is offensive in our sole determination, or that we reject for any other reason in our sole discretion. You agree to provide us with, and keep up-to-date, accurate, truthful and complete account information (including, but not limited to your e-mail address).

You may only have one account. Your account is non-transferable and may not be sold, combined or otherwise shared with another person, except as provided in this paragraph.  If you violate this Agreement, commit fraud or falsify information in connection with your use of the Program as determined in our sole discretion, we may deactivate and/or terminate your account, and you will forfeit any pending current or future Rewards. You may elect to close your account at any time by notifying us at  www.luckysevengeneralstores.com/contactus/.  Any rights to redeem PERKS! from a closed account are lost.

Your account status is communicated to you three ways:

  • Paper Receipt: With each purchase using your PERKS! Reward Card, the receipt from either the cash register or pump will include your current status of all components of the Program except for the PERKS! Pay Debit and Reward Card. 
  • On-Line:  www.luckysevengeneralstores.com/perks will provide your current status in the Program.  It will not provide information about your PERKS! Pay Debit and Reward Card.  For debit information log on to www.luckyseven.poweredbyzipline.com or call our processor and administrator at 844.227.3622 .  This number is also on the back of your card under “PERKS! PAY DEBIT.”
  • Smart Phone App: Once downloaded and registered, your app will have your current reward information.  The app will not have information concerning your PERKS! Pay Debit and Reward Card. 
  1. Earning Program Rewards.

You are eligible to earn rewards as follows, subject to the terms set forth in this Agreement and as amended from time to time by the Company.

  • Welcome Reward:  You can earn a Welcome reward upon successful registration in the Program.  This reward provides you with an immediate gas discount.  This reward supersedes the My Visit! Reward as set forth below until this Welcome reward expires.  For the first 30 days after registration, you will receive a Welcome fuel reward of up to 10 cents per gallon at the pump and will earn points toward a 5% Lucky Buck in-store credit for all qualified purchases including fuel.  The fuel discount is made up of two components; a limited time, 7 cents per gallon discount and a permanent 3 cent per gallon PERKS! Pay Debit and Reward Card if upgraded (see below).

After you have had your Welcome reward expires you will be fully enrolled in the Program and will be able to take advantage of the following components:

  • “My Visit” Reward:  You can earn a “visit credit” after an in-store purchase or fuel purchase.  You may only receive one visit credit in any two hour period.  Visit credits accumulate on a monthly basis.  At the end of each month, you can receive “Lucky Bucks” or gas discounts depending upon the number of visit credits you accumulate.  Fuel discounts will be available to you for the entire following month.  You will earn “Lucky Bucks” for up to 4 visits in a single calendar month.  After your 4th visit in a calendar month, you will receive a fuel discount of 3 cents per gallon that may be used for all fuel purchases the following calendar month.  After your 10th visit in a calendar month, you will receive an additional fuel discount.  Lucky Buck accumulation continues for all of your visits.
  • “My Fuel” Reward:  You can earn fuel discounts by purchasing qualified products at Lucky Seven General Stores, Lucky Seven Sporting Goods Stores and Little Brown Jug stores.  These one-time fuel discounts range from 3 to 20 cents per gallon.  These discounts are in addition to the fuel discounts that you can earn under the My Visits! Reward portion of the Program.  My Fuel rewards can be earned by a one-time purchase of qualified products at any Lucky Seven General Store, Lucky Seven Sporting Goods, or Little Brown Jug locations.  My Fuel Perks! Rewards are “stackable” discounts that come in the following amounts:.03, .05, .07, .10, and .15 cents per gallon of fuel (not to exceed .19 cents total).  Items with an associated My Fuel Perks! Reward will be advertised in-store, on the app and on our website along with the gas discount associated with each item. You will be notified when a discount is available.  Discounts should be used within two weeks to avoid expiration and are limited to 15 gallons of fuel. 
  • “My Club” Reward:  Upon the purchase of particular items as designated by the Company, you may earn a free item based upon your purchase.   These rewards work like an electronic “punch card.”  Electronic punches may be earned by purchasing the same item repeatedly until the items advertised reward level is met.  The next time you purchase the item you will be notified that the item can be received free of charge.  You should redeem their free item within two weeks of notification to avoid expiration.   My Club! Items and the number of purchases needed to earn a reward are advertised in-store, on the mobile app, or on our website.  This component of the program resets twice annually on July 1 and January 1.
  • “Lucky Bucks In-Store Credit” Reward:  You can earn points for each gallon of gas purchased and for purchases of qualified in-store items.  After you have earned 200 points are earned, you will receive a $2 in-store credit that can be applied to many items at Lucky Seven General Stores, Lucky Seven Sporting Goods Stores and Little Brown Jug stores.  Certain items are excluded including but not limited to pre-loaded gift cards,  ATM transactions, licenses, lottery and fuel.  You will be notified when you have accumulated a reward of $5.  Redeem your Lucky Bucks Rewards soon after you are notified.  Lucky Bucks rewards will expire but are valid for a minimum of two weeks after notification.  Lucky Bucks points will expire but are valid for a minimum 60 days after issuance
  • “My Ticket Reward” Reward:  Each time you visit a Lucky Seven General Store, Lucky Seven Sporting Goods store or a Little Brown Jug store you can earn a chance to win tickets to sporting events, movies, concerts, amusement parks, and similar events and attractions.  These Rewards may be earned by participating in certain contests called My Ticket Rewards! and by taking certain actions or making certain purchases or actions as specified by us.   You acknowledge that the Company may enter you into a contest without your specific consent or prior knowledge as your participation in the PERKS! program automatically grants us that consent.  Members under the age of 18 are prohibited from winning My Tickets! Reward.  In all other cases members reserve the right to reject the reward.   Entry into a My Tickets! Reward may be either visit based or purchase based at our discretion.   Contest entries will be closed approximately two weeks prior to the event date allowing us time to select and notify the potential winners.  We will notify potential winners at the same time at least a week before the event by email if your name was picked as a potential winner.  The first potential winner to notify us and claim the prize in the form and manner indicated will win the prize.
  • My CouponsReward:  You may receive electronic manufacturer’s coupons from time to time.
  • “PERKS! Pay Debit Card” Reward:  You may upgrade your Perks! Reward card to a Perks! Pay Debit Card by linking your debit card to your Perks! Reward card (as described below).  This will allow you to use your Perks! Reward card to make purchases, both in the store and at the pump.  You will earn a discount of 3 cents per gallon for fuel purchases in addition to any reward earned above.  If you have a question about a Perks!   1. Redeeming Program Rewards.

Rewards earned will be available for use within twenty-four hours after you register and 24 hours after you earn your reward.  Your reward will be published on your account at www.luckysevengeneralstores.com/perks.  The availability of any additional rewards will be governed by the separate terms of that promotional or rewards offer. PERKS! Rewards will be redeemed on a first-earned, first-redeemed basis.  All PERKS! Rewards redemptions are final and may not be canceled or changed. My Fuel PERKS! may be combined with various fuel discount promotions that discount fuel prices at the pump or in-store (not to exceed $0.19 per gallon).

  1. Rewards Expiration.
  • “My Visit” Reward:  At the end of the current month your My Visit! Reward resets to zero; however, the fuel discount level that you attained in the current month (Regular, Premium or Top Tier) expires at the end of the month following the current month.  My Visits! Rewards accumulate in the current month in the same manner and will be issued in the same manner for future months until the program ends or is modified by us.
  • “My Fuel” Reward:  Fuel discounts expire two weeks after the reward is issued.  My Fuel! Rewards are valid for a single-use up to 15 gallons of fuel.  Any unused discounts are forfeited.  If you pump less than 15 gallons in a single transaction when redeeming your discounts, you immediately forfeit the discounts on those remaining un-pumped gallons.
  • “My Club” Reward:  Electronic punches, accruals and rewards expire bi-annually, on July 1 and Jan 1 of each year.
  • “Lucky Bucks In-Store Credit” Reward:  Points will expire 60 days after they are issued. 
  • “My Ticket Reward” Reward:  Entries will accumulate from the start date of the promotion to approximately two weeks prior to the event date or as the advertised date allowing us time to select and notify potential winners.  Potential winners will be notified by email no later than one week prior to the event.  The event winner will be the first to respond to the email.
  • My CouponsReward:  have varying expiration terms which will be defined by the separate terms of each promotion.
  1. Perks! Pay Debit and Reward Card.

When registering to become a PERKS! Reward member you may upgrade to a Perks! Pay Debit and Reward Card.  This update will link your Perks! Reward Card to your debit card.  This will allow you to use your Perks! Reward card to make purchases, both in the store and at the pump.  You will earn a discount of 3 cents per gallon for fuel purchases.

To enroll you will need to supply a valid driver’s license and banking information at www.luckyseven.poweredbyzipline.com/enroll. This is a secure site will allow you to have one card for rewards and payment. Upgrading your card to Perks! Pay Debit and Reward Card is totally optional and not a requirement of the Program.   Upgrading your card to a Perks! Pay Debit and Reward Card provides you a reward component that rolls back the pump price a minimum of three cents per gallon every day and more on select days.  Once your information is entered, the processor will perform a test charge draft of $.01and then a return credit on your bank account to confirm the validity of your banking information. This may take a few days for both transactions to occur.  When you see both transactions appear,  members may then use their Perks! Pay Debit and Reward Card for both payment and reward activity.

The Perks! Pay Debit and Reward Card is not subject to an annual program fee. This is a secure program administered by a third party.  The Company has no access to your banking account, payment transactions or account information. If you have a question about a Perks!   1. Program Restrictions.

We reserve the right to approve, deny or revoke participation in the Program to any individual for any reason whatsoever on an immediate basis and without prior notice. If we determine that you have registered more than one (1) account to your name/business, we reserve the right to terminate all of your accounts without further notice.

  1. Privacy.

Please refer to our Privacy Policy for information on how we use and collect information on our website, mobile app, and other means. This can be found at luckysevengeneralstores.com/privacy.

  1. Modification.

We may cancel, modify, restrict, waive or terminate any of the terms and conditions herein, including but not limited to the rules for earning and redeeming PERKS! Rewards and the expiration policy for PERKS! Rewards, at any time, with or without notice to you, even though these changes may affect your ability to use any Rewards you have already earned. Your continued participation in the Program constitutes your acceptance of any changes to the terms and conditions of the program. You are responsible for remaining knowledgeable of any changes that we make to the program and the program rules. The most current version of these program and program rules will be available on the website www.luckysevengeneralstores.com and will supersede all previous versions of these Program Rules.

  1. Termination.

The Program has no predetermined termination date and may continue until such time as we decide to terminate the Program. We may terminate the program at any time in our sole discretion. If we terminate the Program, we will notify you via the email address you supplied at the time of registration. Upon termination of the Program, your ability to earn additional PERKS! Rewards will terminate immediately, and you will have to use any available PERKS! Rewards remaining in your

account prior to the expiration pursuant to the above-referenced expiration of Rewards.  After that date, any remaining Rewards will be forfeited without compensation. We reserve the right to deactivate your account after 6 consecutive months of no account activity.

  1. Miscellaneous.

We make no guarantees, warranties or representations of any kind concerning the program. By participating in the Program, you accept and agree to be bound by these program pules, and you release us and our affiliates and partners from liability regarding any earning, redemption and use of rewards, including any rewards that, after receipt, may be lost, stolen or destroyed. You also expressly acknowledge and agree that you are not entitled to rely upon, and have not relied upon, any representation by us that is not expressly stated in these program rules.

The Program is void where prohibited by federal, state or local law. This Agreement sets forth all the terms of the Program. We have no other obligation with respect to the Program beyond those described in this Agreement.

The descriptions, pictures, representations of products, promotions and or other information available through the Program may contain inaccuracies and/or errors.  The Company does not make any warranty or representation with respect to the accuracy or completeness of any such information and reserves the right to correct the same without penalty.  Furthermore, the prices and availability of products referenced through the Program may change without prior notice to you at any time in the Company’s sole discretion.  The Company shall have the right to refuse or cancel any advertisements placed or listed at an incorrect price or location.

Rewards are issued for promotional purposes only. Rewards earned have no cash value. Rewards may not be assigned, sold, transferred, and/or pledged to any third party.  Rewards cannot be transferred to another Program user. You have no property rights or other legal interests in Rewards. Rewards from separately enrolled accounts may not be combined into one account. There is no maximum amount of Rewards that you can accumulate in the program.  All Rewards are subject to expiration. Rewards may only be earned in-store or at the fuel dispenser.

We have the right to monitor all account activity. If in our sole discretion, we believe or suspect that you or anyone using your card or account has engaged in any fraud, abuse or suspicious activity; failed to follow the program Rules; or made any misrepresentations, we reserve the right to close or freeze your account immediately, prohibit you from accruing and/or earning rewards on your account, and/or cause you to forfeit any rewards not already redeemed. If your rewards are canceled or forfeited for any reason, we will not reinstate those rewards to your account. If your account is closed for any reason, your membership in the program will be terminated. We have the right to deactivate accounts that have been inactive for 6 consecutive months. If we believe that you, or anyone using your card or account, has conducted any fraudulent activity, we reserve the right to take any necessary legal action and may have grounds to confiscate any rewards redeemed as a result of such activity. In addition, you may be liable to us for monetary losses, including costs, and damages and reasonable attorneys’ fees, and you will not be allowed to participate in the program in the future.

The Company manages the Program within the State of Minnesota.  If you choose to use and/or participate in the Program from any other location, state or country, you do so at your own risk and initiative and are solely responsible for compliance with any applicable local laws and regulations.  You agree that the laws of the State of Minnesota govern your rights and obligations relating to the Company and the Program, and exclusive jurisdiction and venue for any disputes relating to this Agreement or the Program shall be the state or federal courts located in the State of Minnesota.

The Program is void where prohibited. Your points and redeemed rewards are promotional in nature, have no cash value, and cannot be sold, copied, shared, transferred or used for commercial purposes. The Company reserves the right to impose volume or other limitations on items and/or to offer different and/or additional benefits to some participants based on geographic location, participation in the Program, or other criteria determined by us in our sole discretion or as required by applicable law.

If any provision of this Agreement is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of the Agreement, all of which shall remain in full force and effect. Failure to exercise or delay in exercising any right, power or privilege by the Company under this Agreement shall not constitute any waiver or modification of the terms of this Agreement by the Company.

This Agreement contains the entire agreement between you and the Company with respect to the Program.  Any and all prior agreements, representations, statements, negotiations, and undertakings with respect to the subject matter herein are superseded by this Agreement.  Terms that by their nature are intended to survive the termination, cancellation, or expiration of this Agreement shall survive.
